Tutoring Service Agreement

A formal agreement between Ebata L.U.M.A. Studio and the Parent/Guardian of the named Student.

Article 1

Parties to the Agreement

This Tutoring Service Agreement ('Agreement') is entered into on the Effective Date specified below, by and between Ebata L.U.M.A. Studio ('Provider') and the Parent/Guardian identified herein ('Client'), for the benefit of the Student named below.

Ebata L.U.M.A. Studio agrees to provide one-on-one inclusive tutoring services to the Student in the following subject area(s): .

Cancellation Policy

Cancellations made with at least twenty-four (24) hours' notice will not be charged. Cancellations within 24 hours of the scheduled session or no-shows will be billed at the full session rate. Make-up sessions for late-cancellations are at the Provider's sole discretion.

Article 6

Missed Session Policy

Make-up sessions for late-cancellations or no-shows are not guaranteed. Make-up sessions due to Provider cancellation will be scheduled within two (2) weeks at a mutually agreeable time. Repeated no-shows (three or more in a billing cycle) may result in termination of this Agreement at the Provider's discretion.

Article 7

Confidentiality

Ebata L.U.M.A. Studio agrees to maintain the confidentiality of all student information, academic records, work samples, assessments, and communications, in alignment with FERPA principles. Student information will not be shared with third parties without the written consent of the Parent/Guardian, except as required by law or in cases involving safety concerns where mandatory reporting obligations apply.

Article 8

Photo & Work Sample Release (OPT-IN)

I, the undersigned Parent/Guardian, hereby:

permission for Ebata L.U.M.A. Studio to use my child's anonymized work samples, photographs, and testimonial quotes for educational, marketing, and promotional purposes including but not limited to website content, social media, and program materials. Student names will never be used without separate written consent.

Article 9

Termination

Either party may terminate this Agreement with two (2) weeks' written notice via email or letter. Outstanding balances must be paid within fourteen (14) days of termination. The Provider reserves the right to terminate immediately, without notice, in cases of non-payment, abusive conduct toward staff, or repeated violations of program policies. Upon termination, all student records will be retained for one (1) year and then securely destroyed unless otherwise required by law.

Article 10

Liability & Hold Harmless

The Provider's liability under this Agreement is strictly limited to the cost of services rendered. Ebata L.U.M.A. Studio is not responsible for academic grades, test scores, school placement decisions, or specific learning outcomes. The Parent/Guardian agrees to hold Ebata L.U.M.A. Studio, its tutors, contractors, and representatives harmless from any claims arising from the tutoring relationship, except in cases of gross negligence or willful misconduct.

Article 11

Inclusive Practice Statement

Ebata L.U.M.A. Studio is committed to inclusive practice for every learner. We honor IEP and 504 accommodations, take a strengths-based approach to instruction, support neurodivergent learners, and embrace cultural, linguistic, and socioeconomic diversity. Our pedagogy is rooted in the L.U.M.A. framework — Learner-Centered, Uplifting, Measurable, and Achievement-oriented practice — and we pledge to uphold this standard in every session with the Student.

Article 12

Communication & Updates

The Parent/Guardian will receive a written monthly progress report summarizing the Student's growth, goals, and recommendations. The Tutor will respond to non-emergency communications within twenty-four (24) business hours. Parents are encouraged to share concerns, celebrations, and outside-of-session observations to support the Student's progress. A scheduled parent-tutor conference may be requested at any time.
